These terms govern the use of the BlackDesert website and the guided desert expedition services provided by ABCD Black Desert, LLC. Please read this document carefully before making a booking.

1. Acceptance of These Terms

These Terms of Service form a binding agreement between you and ABCD Black Desert, LLC, a company registered in the United States at 2449 Vineyard Dr, Santa Clara - 84765-5439, United States (US). By accessing this website, by submitting a booking request, by paying a deposit, or by joining any expedition, you confirm that you have read, understood, and agreed to be bound by these terms.

If you do not agree with any part of these terms, you must not use the website or book our services. We may revise these terms from time to time, and the version published on this page is the version that applies to your booking at the time it is confirmed.

2. About Our Company

The BlackDesert expedition services are developed and operated by the developer BlackDesert on behalf of ABCD Black Desert, LLC. Our office and trailhead base are located at 2449 Vineyard Dr, Santa Clara - 84765-5439, United States (US).

We operate under the permits and authorizations required for guided activities in the public lands around Santa Clara, Utah, and we hold commercial liability coverage as required by law. References in these terms to we, us, and our mean ABCD Black Desert, LLC and its authorized guides. References to you mean the traveler, participant, or visitor, and where a booking is made on behalf of others, the person making the booking acts as the agent for each participant and accepts these terms on their behalf.

3. Eligibility

To book an expedition you must be at least eighteen years of age. Children aged ten and older may join selected routes when accompanied by a parent or guardian who assumes full responsibility for them throughout the trip.

You must be physically able to complete the route you select, and you must be honest about your fitness and any medical conditions when you complete the booking form. Slot canyon treks and photography tours are limited to travelers aged sixteen and older. We reserve the right to decline a booking or to remove a participant from an expedition if we reasonably believe that they do not meet the eligibility requirements for the route.

4. Booking and Reservations

A reservation is confirmed only when we have received your completed booking form and your deposit or full payment, and when we have sent you a written confirmation by email. A booking request alone does not reserve a place on an expedition.

When you submit a booking form, we will review the route, the dates, the group size, and the weather outlook, and we will respond within one business day. If a requested date is full, we will offer the next available date or a refund of any amount paid. Confirmed bookings are issued with a booking number that you should reference in all future correspondence with us.

5. Pricing and Payment

All prices are listed in United States dollars and are inclusive of applicable taxes unless stated otherwise. Prices include guiding, permits, group safety equipment, meals and water on overnight trips, and the services described on the relevant page of this website.

We accept payment by major credit and debit cards and by bank transfer. For most expeditions, a deposit of fifty percent is required at the time of booking, with the balance due fourteen days before departure. For private group bookings, full payment is due at confirmation. If a payment fails, we will contact you and hold the reservation for forty-eight hours while the payment issue is resolved.

6. Cancellation and Refunds

You may cancel a booking at any time by writing to notify@blackdesert.mom or by calling +16293198553. Refunds are calculated from the date we receive your cancellation notice, as follows.

  • Cancellations received thirty days or more before departure receive a full refund of all amounts paid.
  • Cancellations received between fifteen and twenty-nine days before departure receive a refund of fifty percent of the total price.
  • Cancellations received fourteen days or fewer before departure are not refundable, because permits, guide time, and camp provisions are committed well in advance.

If we cancel an expedition for any reason on our side, including unsafe weather, fire danger, or closure of a route, you receive a full refund of all amounts paid or a full credit toward a rescheduled date, at your choice. Refunds are processed to the original payment method within fourteen business days.

7. Expedition Modifications

Desert conditions change quickly, and we reserve the right to modify an itinerary, a meeting time, or a route at any point, including during the expedition itself, when safety or access requires it. Guides may shorten a crossing, change a campsite, or turn a group around early in response to weather, trail conditions, or the fitness of the group.

We will make every reasonable effort to preserve the character of the planned experience, and we will explain any modification to the group as it happens. No refund is owed for itinerary modifications that are made for safety reasons, because your safety is always the first condition of any route we run.

8. Group Size and Joining

Our public expeditions are kept small by design. Most routes accept between four and twelve travelers so that the group moves quietly and the land stays undisturbed. Private bookings may be arranged for larger groups, subject to permit capacity.

We may merge two small bookings onto the same departure to keep a route viable, and we will tell you about any merged group before departure. You must arrive at the meeting point at the time stated in your briefing pack. If you arrive more than thirty minutes late and the group has left, the departure is treated as a same day cancellation, and the cancellation rules in Section 6 apply.

9. Health and Physical Fitness

Guided desert travel requires a reasonable level of fitness, stable health, and the ability to walk on soft, uneven ground for several hours. By booking, you confirm that you are in good health and that you have no condition that would make the selected route unsafe for you or for the group.

You must disclose any medical condition, allergy, medication, or physical limitation that could affect your participation or the safety of the group when you complete the booking form. This information is used only to plan a safe route and is handled in accordance with our Privacy Policy. Our guides are trained in wilderness first aid, but they are not physicians, and participation does not constitute medical advice.

10. Safety and Guide Authority

Our guides are certified, permitted, and trained in wilderness first aid and emergency response. Their instructions regarding safety, route selection, pacing, equipment use, and group behavior are final and must be followed at all times.

In the event of an emergency, a guide may take any action necessary to protect the safety of the group, including evacuating a participant, modifying the route, calling for assistance, or ending the expedition early. A participant who ignores safety instructions, acts recklessly, or refuses to follow guide directions may be removed from the expedition. In such a case, no refund is owed and the participant is responsible for their own evacuation and return transport.

11. Participant Responsibilities

Every participant is responsible for their own conduct, their personal gear, and their decisions while on an expedition. You must arrive with the equipment listed in your briefing pack, carrying the water and layers that the route requires, and you must tell your guide immediately if you feel unwell, thirsty, tired, or unsafe at any point.

You are expected to treat other participants, our guides, and the land itself with respect. This means leaving no trace, staying on the assigned route, caring for shared equipment, and following the group schedule. You are responsible for keeping your personal valuables and for ensuring that any item you bring does not endanger other people.

12. Risk Assumption and Waiver

Desert expeditions involve inherent risks, including but not limited to extreme heat and cold, dehydration, sun exposure, uneven terrain, loose rock, flash floods, wildlife encounters, and the limitations of communication in remote areas. You acknowledge that these risks exist and that no amount of care can remove them entirely.

By booking and participating, you voluntarily assume all risks associated with the expedition, whether known or unknown, to the fullest extent permitted by law. Before you join any expedition, you will be asked to sign a liability waiver and assumption of risk form. If you decline to sign that form, you will not be permitted to participate, and the cancellation rules in Section 6 will apply to your booking.

13. Insurance

We strongly recommend that every participant carry personal travel and medical insurance that covers emergency evacuation from remote areas and cancellation for personal reasons. Our guides carry wilderness first aid supplies and communication devices, but they do not replace your own insurance coverage.

If you require medical attention during an expedition, any costs of transport, treatment, or evacuation are your responsibility and may be claimed under your own policy. We will cooperate fully with your insurer and with emergency services, and we will provide the documentation that your insurer reasonably requests.

14. Intellectual Property

The content of this website, including text, design, the BlackDesert name, the crescent moon mark, the dune and camel artwork, and all photographs, is owned by ABCD Black Desert, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, print, and download portions of this website for your personal, non commercial use. You may not copy, reproduce, republish, modify, distribute, sell, or create derivative works from any part of this website without our prior written permission. Any unauthorized use of our marks may result in legal action.

15. Acceptable Use of the Website

You agree to use this website only for lawful purposes and in a way that does not interfere with its operation or with other users. You must not attempt to gain unauthorized access to our systems, introduce harmful code, scrape the site at volume, or submit false, fraudulent, or abusive information through our forms.

We may monitor website activity to maintain security and to detect abuse. We may suspend or block access to the website for any user who we reasonably believe is violating these terms, and we may report unlawful activity to the appropriate authorities.

This website may contain links to websites owned or operated by third parties, including payment processors, booking partners, and weather and trail information services. These links are provided for your convenience, and we do not control and are not responsible for the content, accuracy, or practices of any third party website.

The presence of a link does not constitute our endorsement of the linked site. Your use of any third party website is subject to the terms and policies of that website, and we encourage you to review them before providing any personal information.

17. Limitation of Liability

To the maximum extent permitted by law, ABCD Black Desert, LLC, its officers, employees, guides, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of enjoyment, arising from or related to your use of the website or your participation in any expedition.

Our total liability to you for any claim arising out of or relating to these terms, the website, or an expedition is limited to the amount you actually paid to us for the specific expedition or service that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence.

18. Indemnification

You agree to indemnify and hold harmless ABCD Black Desert, LLC, its officers, employees, guides, and agents from and against any claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these terms, your violation of any law or regulation, or your conduct during an expedition.

This indemnification applies only to the extent that the claim arises from your own acts or omissions and does not apply where the claim results from our negligence or willful misconduct. We will provide you with prompt notice of any claim that is subject to this indemnification, and we will cooperate with you in the defense of that claim at your expense.

19. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any dispute arising out of or relating to these terms, the website, or our services will be subject to the exclusive jurisdiction of the state and federal courts located in Washington County, Utah.

Before filing any claim, you agree to make a good faith effort to resolve the dispute informally by writing to notify@blackdesert.mom or by calling +16293198553. If the dispute is not resolved within thirty days of our receipt of your notice, either party may pursue the claim in the courts described above. You agree that any claim must be brought within one year after the claim arises, except where a longer period is required by law.

20. Termination

We may suspend or terminate your access to the website, or cancel your participation in an expedition, at any time and for any lawful reason, including a breach of these terms. Upon termination, your right to use the website ends immediately, and any applicable refunds are calculated under the cancellation rules in Section 6.

Sections that by their nature should survive termination, including Sections 12 through 19, will continue to apply after any termination of these terms or your access to the website.

21. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, our permits, or the law. When we make changes, we will revise the effective date at the top of this page and, where the changes are material, we will provide a notice on the homepage or by email to the address we have on file.

Changes apply to bookings made on or after the new effective date. Bookings already confirmed remain governed by the terms that were in effect when the booking was confirmed, except where the change is required by law. Your continued use of the website after a change takes effect means that you accept the updated terms.
